Definitions

1.1 In these Terms and Conditions, the following terms (both singular and plural) have the following meanings:

'Terms and Conditions, the general terms and conditions of I Love Prague Tours;
“Event” means a private or public event involving - for example, but not exclusively - an activity of a touristic nature, including - but not limited to - an excursion, a museum visit, a concert or a sporting event;
“Location”, the place where the event takes place;
"Organiser", the party responsible for the production and/or organization of the event;
"Agreement", the agreement between I Love Prague Tours and the consumer for the sale and delivery of the tickets.
“Tickets/Tickets”, proof of entry to an event;

2. Applicability.

2.1 The general conditions below and the conditions of booking and ordering at I Love Prague Tours apply to all offers, orders and agreements of I Love Prague Tours.

2.2 In addition, the General Terms and Conditions of the organizer and the General Terms and Conditions of the party responsible for the venues also apply to the agreement. If during the event there is a conflict between the clauses in the general terms and conditions and the aforementioned general terms and conditions, the clauses in these general terms and conditions will prevail. Copies of the Terms and Conditions of the party responsible for the Venue or organizer are available upon request from the person responsible for the venue in question or from the organiser.

2.3 When buying a product or ordering a product, the consumer must agree that the general terms and conditions can be applied.

2.4 Deviations from the clauses in the General Terms and Conditions are only available in writing, in which case the other clauses will remain in effect.

2.5 All rights and claims stipulated for I Love Prague Tours in these general terms and conditions and further agreements also apply to intermediaries and other third parties engaged by I Love Prague Tours.

3. Prices/Offers

3.1 All offers made by I Love Prague Tours are without obligations and I Love Prague Tours has the right to change its prices, in particular if it is necessary for public law or other regulations.

3.2 All prices are indicated in euros or Czech Crowns, including VAT.

3.3 In some cases, promotional prices may apply. These prices are valid during a specific period while stocks last. Prices cannot be activated before or after this specific period.

3.4 I Love Prague Tours cannot be held to prices that are clearly incorrect, for example as a result of typing or printing errors. No rights can be derived from incorrect price information.

3.5 For each ticket, a fixed amount of service fees will be charged, which will vary based on the event. The service costs include transaction costs, consultation costs and shipping costs.

4. Cancellations and returns

4.1 An organizer is authorized to cancel an event or change the relevant date. If this happens, I Love Prague Tours will come up with an acceptable solution. If an event has been canceled or postponed, I Love Prague Tours will do its utmost to inform you about this change as soon as possible. However, I Love Prague Tours cannot guarantee the possibility to inform you in time if a tour is canceled or takes place at a different time than agreed. Also, I Love Prague Tours is not responsible for refunds, competition or for costs that you would like to get back, for example travel costs, accommodation costs and/or other related goods or services.
4.2 Before you confirm your booking, you should always check whether you have ordered the correct number of tickets. Tickets for a product with a specific date or time (tickets with a time slot) can no longer be exchanged. Wrongly van (numbers of) open tickets (tickets without a specific date and time) are exchangeable within fourteen days of purchase if purchased online. If you want your money back after ordering an open ticket, you must send an email to mail@i-love-praag.nl.
4.3 I Love Prague Tours is not liable for damage, misuse or loss of tickets. No duplicate tickets will be issued to replace tickets that have been misused, mutilated, lost or stolen, nor will such tickets be refunded.
4.4 I Love Prague Tours is not liable for delay, non-delivery or incorrect delivery of tickets, if you are dealing with a delay, non-delivery or incorrect delivery of your tickets you cannot blame I Love Prague Tours.
4.5 Failure to use one or more pre-purchased tickets is at your own expense and risk; this is also the case if the admission ticket is only valid for a specific time and/or date.
4.6 Our open tickets are valid for 1 year (12 months) from the date of purchase.
4.7 When rebooking an excursion, attraction, canal cruise or museum, the traveler will be charged a fee.

5. Payments

I Love Prague Tours accepts different payment methods. Payments in euros and Czech crowns must be paid via iDEAL or via credit card. On request, cash payment at the start of the activity is also possible in certain cases. You will only receive a final confirmation of your booking when you have paid.

6. Delivery

6.1 Depending on the shipping method, the tickets will be delivered to the respective address available in the I Love Prague Tours addresses database.
6.2 The shipping times stated by I Love Prague Tours are for indicative purposes only. Failure to meet the delivery term does not entitle you to compensation, nor to the right to cancel your order or to dissolve the agreement, unless the non-compliance with the delivery term is so serious that you cannot reasonably be required to comply with holds the agreement. In that case, you have the right to cancel your order or dissolve the agreement insofar as this is necessary.

7. Retention of Title

7.1 Ownership of the delivered tickets will only be transferred to you if you have fulfilled all your obligations to I Love Prague Tours under any agreement whatsoever. Risk in the tickets will pass to you at the time of delivery.

8. Complaints and Liability

8.1 You are obliged to check upon delivery whether the tickets are in accordance with the agreement. If this is not the case, you must inform I Love Prague Tours in writing as soon as possible, or within (3) days after delivery, with the relevant reasons that make it clear that this is the case.
8.2 If it is indicated that the tickets do not correspond to the agreements, I Love Prague Tours can choose to replace the tickets in question with new tickets in exchange for new tickets or to refund the amount paid.
8.3 Unresolved consumer complaints about digitally purchased products on the I Love Prague Tours websites can be resolved through Online Dispute Resolution.\

9. Electronic Communications and Evidence.

9.1 I Love Prague Tours is not responsible for misunderstandings, delays, distortions or incorrect transmission of data and messages as a result of the use of the internet or other communication sources in the traffic between the customer and I Love Prague Tours (or the parties authorized by the customer have been deployed).
9.2 The data of I Love Prague Tours serve as proof of the existence, content and implementation of the agreement with the customer in legal proceedings, subject to evidence to the contrary by the party that invokes the fact that the evidence is unreliable.

10. Force majeure

10.1 Without prejudice to other rights that may be claimed, in the event of force majeure, I Love Prague Tours has the right, at its own discretion, to suspend the execution of your order or to dissolve the agreement without judicial intervention. , by informing you of this in writing, without I Love Prague Tours being liable for damages, unless it would be unacceptable in the prevailing circumstances with reasonableness and fairness.
10.2 Force majeure is understood to mean any shortcoming that cannot be attributed to I Love Prague Tours, because it cannot be attributed to it nor can it be considered its responsibility in accordance with the law, legal action or generally accepted standards.

11. Special Provisions, Liability

11.1 The purchaser of a ticket supplied by I Love Prague Tours must behave as a well-ordered visitor to events and adhere to the instructions given to him by or on behalf of the organizer of the event to be visited, as well as by the competent authority.
11.2 I Love Prague Tours is not liable for any refusal by the organizer of an event or by government authorities to inform the purchaser of a ticket provided by I Love Praag Tours to an event as a result of actions and/or negligence on the part of the buyer.
11.3 The purchaser of a ticket attends the event at his own risk. I Love Prague Tours is not liable for any damage incurred by the buyer during the journey to or from the event or during the event.
11.4 The purchaser of a ticket supplied by I Love Prague Tours must inform himself about the instructions issued by or on behalf of the event organizer or the authorities attached thereto, including any changes related to the event, such as the starting time, etc. I Love Prague Tours is not obliged to provide the buyer of a ticket with further information about this.

12. Other Provisions

12.1 If one or more of the provisions in these General Terms and Conditions or any other agreement with I Love Prague Tours are in conflict with an applicable legal regulation, the relevant provision will lapse and will be replaced by a new legally applicable provision made by I Love Prague. Tours is determined.
12.2 Dutch law applies to all agreements entered into or concluded by I Love Prague Tours. All disputes arising directly or indirectly from these agreements will be settled exclusively by the Midden Nederland Court in Utrecht, the Netherlands.
